These Terms of Use ("Terms") are a binding agreement between you and Joinix Team ("Joinix Team", "we", "us", or "our") governing your access to and use of the Joinix mobile application and related services (collectively, the "App" or "Services").
By downloading, accessing, or using the Services, you agree to these Terms.
1) The Services
Joinix helps you set, track, and achieve personal goals with features such as goal creation, progress tracking, weekly/monthly goal cards, milestone recording, and reflection tools. We may add, remove, or modify features over time.
2) Account Registration and Security
- You may need an account to use certain features.
- You agree to provide accurate information and keep it up to date.
- You are responsible for activity under your account and keeping credentials confidential.
3) Your Content
"User Content" means content you submit, upload, store, or generate through the Services, such as goals, reflections, support requests, text, and images. You retain ownership of your User Content.
You grant Joinix Team a limited license to host, store, reproduce, process, and display your User Content only as necessary to provide, maintain, and improve the Services, and to comply with law.
4) Acceptable Use
- No unauthorized access, interference, malware, or abuse.
- No illegal use, harassment, or infringement of others' rights.
- No reverse engineering except where permitted by law.
5) Privacy
Our Privacy Policy describes how we collect, use, and share information. By using the Services, you agree that we can process information as described in the Privacy Policy.
6) Intellectual Property
The Services are owned by Joinix Team or its licensors and are protected by law. Except as expressly permitted, you may not copy, modify, distribute, sell, lease, or create derivative works from the Services.
7) Disclaimers
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, JOINIX TEAM DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
Joinix is for general goal-setting and self-improvement support. It does not provide medical, mental health, legal, or financial advice.
8) Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, JOINIX TEAM WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, JOINIX TEAM'S TOTAL LIABILITY WILL NOT EXCEED THE AMOUNT YOU PAID TO JOINIX TEAM FOR THE SERVICES IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR USD $10 IF YOU PAID NOTHING.
9) Termination
You may stop using the Services at any time. We may suspend or terminate access if we reasonably believe you violated these Terms, we must comply with law, or to protect the Services and users.
10) Governing Law and Dispute Resolution (Binding Arbitration)
These Terms are governed by the laws of the jurisdiction where Joinix Team has its principal place of business, without regard to conflict of law rules.
Any dispute, claim, or controversy arising out of or relating to these Terms or the Services will be resolved by binding arbitration on an individual basis, and not in a class, consolidated, or representative action, except where prohibited by law.
